- Petition of Leonard Higgs, Ella Higgs, Willis Johson and his wife Mary, Kenelm H. White and his wife Elizabeth, Alfred Higgs, William Higgs, George P. Thomasson, and his wife Nancy Thomasson, Willis Johnson and Willis H. Higgs, infant and who say in their behalf by his next friend Allen Higgs, Warner Parham and his wife Mary W., Thomas White and his wife Cassy, Daniel Johnson and his wife Eliza, Green Stanton and wife Mary, Southern I. Higgs, Allen H. Higgs, Susan A. Higgs, Calvin Higgs, Woodson, Kenelm H., Siebert I. Higgs, infants who sue in this behalf by their guardian Thomas H. White. Against the infant child and heirs at law, John Higgs decd. son of John Higgs Sen. whose name is unknown.
- Petitioners humbly show unto your worships that Southern Higgs late of Granville, departed this life in the month of March last, intestate without issue _____ and posessed of a certain tract or parcel of land lying and being in the said county of Granville on Tabs and Ruin Creeks, bounded by the land of Rowland Bryant Sen. James White, the heirs of Charles Whit dec. and ____ consisting by estimation nine hundred and seventy two acres and left him surviving as his heirs at law. Your petitioners and the defendants to whom said land hath decended in fee simple, whom ____ of Relationship to the said intestate are as follows, viz, your petitioners Leonard Higgs, a brother of said intestate: Ella Higgs, Mary who hath intermarried with Willis Johnson, Elizabeth who hath intermarried with Kenelm H. White, Alfred Higgs, William Higgs, and Nancy who hath intermarried George P. Thomasson and who are the children and heirs at law of John Higgs decd. who was a brother of the said Intestate, Willis Johnson a son of Willis Higgs Decd. who hath intermarried with a man by the name of Johnson, and was a sister of said intestate, Southern Higgs, Willis H. Higgs an infant and who sues in their behalf by his next friend Allen H. Higgs, and Mary W. being the children and heirs at law of Mary Johnson, a daughter and one of the heirs at law of the aforesaid Willy Johnson dec. who hath intermarried a certain John Higgs an is now dead. Cassy Higgs now White who hath intermarried with Thomas White, who was the sister of said intestate Southern Higgs. Eliza Higgs now Johnson who hath intermarried with Daniel Johnson who was a sister of said intestate Southern, and Southern I., Allen H., Susan A., Calvin, Woodson, Kenelm H. and Sebert I. Higgs the children and heirs at law of Kenelm Higgs Sen. decd. who was a brother of said Intestate Southern, the said Woodson, Kenelm H. and Sebert and being infants, who sue in this behalf by their guardian, Thomas H. White. And the defendant who is an infant child the heir of John Higgs Jun. Dec. who was one of the children and heirs at law of John Higgs Sen. decd. who was a brother of said intestate Southron as above set forth.
- Your petitioners are advised that the aforenamed tract of land is by law subject of right to be divided into seven equal parts, as near as may be and that one of said parts is asignable to your petitioner Leonard Higgs, one to the children and heirs at law of John Higgs, sen. dec., one to the children and heirs at law of Nelly Johnston decd. one to Cassy White, one to Eliza Johnson, and one to Mary Stanton, and one to the children and heirs of Kenelm Higgs decd. subject to the dower of Rebecca Higgs widow and ____ of said Southern Higgs.
