Obediah2 Overton (apparently John1) was born before 1745 in order for his son, Willis, Sr., to be older than the Willis Overton, Jr., who married in 1788 at, presumably, twenty-one or more years of age. Family tradition holds that Obediah's first wife was Frances [-?-].(35) Positive confirmation of this has not been found; however, the 1782 personal-property tax list of Orange County enigmatically lists "Overton, Obadiah, Fanny"-implying that Obediah was being assessed for personal property owned by a wife of that name. On 31 January 1788 in Culpeper County, to which he had removed, Obediah married Ellender Crow.(36) The last record found of him is his personal-property tax assessment of 1817 in Orange County; no estate record is on file. The widowed Ellender last appears on record in 1824.(37)

Obediah, like his proposed brother George, surfaced in Orange County in the 1770s; both were in their mid-to-late twenties. Three years before George and Obediah affixed their signature to the legislative petition to divide Orange, Obediah made his first appearance of record. On 14 August 1774, he witnessed a deed there between Alexander Spotswood and Aaron Denny.(38)

As with most of this family, the young Obediah is best tracked through tax rolls. From the inception of the state-level rolls in 1782, he is regularly assessed for personal items through 1785 in Orange. By 1787 he had relocated in Culpeper, where one Francis Madison (an apparent employer) was charged with his tithe that year. Through 1791, he paid his own assessment in Culpeper but drops from the roll in 1792-the year that a portion of that county was cut away to create Madison. With the first extant roll for Madison, dated 1793, Obediah can again be tracked through 1801; from there he returned to Orange, whose rolls carry him through 1817.

The county-level records of Madison and Orange augment this skeletal reconstruction of Obediah's life. On 17 April 1796, in Madison, he secured the marriage bond of John Kinser and Lucy Tureman,(39) whose sister Susanah had married Obediah's son Willis three years earlier. In mid-1800, apparently, Obediah and Eleanor disposed of their Madison property in anticipation of a return to Orange. By a deed of 29 July (with a Polly and a Betsy Overton as witnesses), they sold to one Joshua Willis a tract of unspecified size on the "south side of Beautiful Run"-a tract that is not previously accredited to them in either land or tax rolls.(40) Indirect references to this property do exist in two other contexts, however. A series of deeds executed in 1800 and 1801 between William Lospect and Ignatius Tureman mention Obediah Overton's "plantation";(41) and the 1801 assessment rolls show an untaxed tract of unspecified acreage added to the land-tax list for Willis, with the notation "of O. Overton."

Three months after the sale of the Beautiful Run place, Obediah (as a resident of Madison) purchased 169 acres in Orange County;(42) but he did not keep the property. On 27 April 1801, still calling himself a resident of Madison, he and Eleanor deeded the tract, "with love and affection to our son Dudley Overton."(43) It appears likely that the couple moved onto the place with their unmarried son, as Obediah is dropped from the rolls of Madison and appears on the personal-tax lists (but not land rolls) of Orange from 1801 through 1817.

In other records of Orange, Obediah surfaces twice more. In February 1804, he was chosen as guardian by Elizabeth Crow, an orphan [over fourteen years of age, apparently] of James Crow.(44) Finally, on 12 December 1817, he posted the marriage bond for the union of his daughter Fanny to John Riner.(45)

John Howerton (Sr.) should have been born prior to 1723 (assuming he was at least twenty-two when his son George was born) but more probably by 1719 (in order to have attained legal adulthood by his first service as a witness). His only identified wife is Mary [-?-], to whom he was married by 1767 and who appears to have predeceased him. John died shortly before 7 August 1792, the date upon which his will of 27 April 1791 was ordered recorded in Spotsylvania(5). With the exception of two deeds drafted in that county under the name Overton (1),6 all local references call him John Howerton.

This earliest-known progenitor of the line emerges in Spotsylvania County on 21 August 1740, at which time he witnessed a deed from George Dowdey to William Marsh.(7) While exceptions to the rule can be documented, legal witnesses within this society normally had attained the age of majority. Following the title to the land that Dowdey sold provides an apparent clue to the birth family of John. On 1 May 1750, the tract was purchased by one Obediah Howerton, who held it for a year.(8) However, when John Howerton subsequently petitioned for a grant of 350 aces in Saint George's parish of Spotsylvania, the tract he chose (and eventually received a final title to on 7 August 1760) adjoined Obediah (9). This first Obediah, who makes only a cameo appearance in Spotsylvania records, has not yet been placed into a parental family; but a connection to John appears certain(10).

With one possible exception, John's land remained within the family and passed to his offspring. On 28 August 1767, as John Howerton, he and his wife Mary sold 50 acres to James Floyd of Caroline County(11). Whether the "land followed blood" in this case (to use a popular early-American saying) is yet unproved. On 23 October 1786 he disposed of another tract, deeding 100 acres for a token �5 to a William Overton whose relationship was not specified(12). Then, on 7 April 1791, shortly before his death, John gave 150 acres to his son George via a document that renders their name as Howerton(13). The remaining 50-acre parcel of his 1760 grant clearly is the "60" acre tract bequeathed to his granddaughter Frances Carr in the will that he drew up (as a Howerton) three weeks after making his donation to George(14). The discrepancy in acreage might be attributed to a surveying or copying error.

The land disposals by the elderly John are genealogically informative. Donations to a child by an elderly parent, such as the one of 1791 to George, were often made in exchange for a promise of care and maintenance by the favored offspring. Similarly, John's sale to William, with the token compensation of �5 for 100 acres,15 customarily denoted a father-son relationship. The fact that John Howerton was the father of George Howerton/Overton also indicates that John was at least a generation older than any of George's contemporary Overtons or Howertons in Culpeper, Madison, Orange, and Spotsylvania counties (excepting the Obediah of 1750-51). As their elder by one generation, John is a likely candidate for the father of the third Overton who was of the same age group as George and William-i.e., the Obediah with whom this search began.

No direct link has been found between the younger Obediah Overton and John Howerton; but a number of records do suggest a close relationship between Obediah and John's proved son George Howerton/Overton. Obediah and George both strayed to Orange County by 1777, where both signed a legislative petition that year to have Orange divided.(16) Both are also the only Overtons carried on the 1782 personal-property tax books in Orange County. The Spotsylvania personal-property lists for 1798 and 1799 indicate that both of them named a son Willis. In addition, Obediah's son Willis (q.v. no. 11) is found in possession, without benefit of a legal tide, of a tract of land that had earlier belonged to George.

- 15. The paltry price placed upon these 100 acres is clear from a study of other deeds in the county. For example, in 1779, a 100-acre tract taxed at the same rate as the Howerton land was sold for �40; a 50-acre tract, also taxed at the same rate, was sold in 1780 for �100 pounds; see Spotsylvania Co. Deed Book J:508, 568.
